DELTA 8 THC suppliers are suing the DEA!
While the list of companies still offering DELTA 8 THC products, is shrinking by the day, few hemp suppliers have decided that they are sueing the DEA. One of these companies is Hempire Direct, a (former) leading supplier of DELTA 8, that made it clear it is going to fight the DEA in court.
While Hempire announced it is going to stop selling DELTA 8 THC, other comapnies decided to ignore the DEA’s statement, so for now, DELTA 8 THC products are still sold online.

Companies Taking Action
The company currently leading the battle to restore the sale of DELTA 8 THC products is Hempire Direct. While they had to stop selling the products, they have announced that they are sueing the DEA and won’t stop until the sale of DELTA 8 products will be allowed again.
This is the email they have sent to their clients:
“For those of you following the Delta 8 situation this message is for you. First of all I would like to thank each and everyone of you for your business.
It’s been great to experiance all the amazing things that this product has done for people in such a short amount of time.
It’s with great saddness, I have to say, in light of recent events the DEA implemented, under the advice of our 2 cannabis law firms, we are removing our delta 8 products from our site.
There was a miscommunication over the weekend and we are still unsure if the rules are effective immedately or not.
The vendor supplying us with our delta 8 agreed to take it all our left over stock back. So that stopped us from going out of business.
While some other companies are selling delta 8, we are not.
We hope this will all blow over soon.
We’ve been getting a lot of emails asking how our customers can help and the best thing to do is to make a public comment on this issue.“

From the content of the engagement letter, below, we can learn that the company is going to attack the basic claim of the DEA that DELTA 8 THC products are illegal “Attorney and Client desire to sue and fight the DEA to require it to not employ any Ex Post Facto laws that may jeopardized Client’s legitimate hemp business actions, or enforce its interpretation of D8-THC being a schedule I synthetic form of THC”

Full text below:
“B. Attorney and Client desire to contest recent DEA actions to publish an interim final rule (IFR) regarding the 2018 Farm Bill that legalized hemp, and its derivatives, with a delta-9 THC level of 0.3% or less.
C. The DEA IFR claims that any tetrahydrocannabinols (THC) are still schedule I substances under the Controlled Substances Act (Drug Code 7370).
D. Therefore D-8 THC derived from the Hemp cannabinoids is still considered to be a Schedule I substance.
E. The DEA has a rule that directly conflicts with the statutory definition of hemp, which is: The term ‘hemp’ means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9-tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.
F. Attorney and Client desire to sue and fight the DEA to require it to not employ any Ex Post Facto laws that may jeopardized Client’s legitimate hemp business actions, or enforce its interpretation of D8-THC being a schedule I synthetic form of THC (the “Litigation”).”
